What Florida Law Says About Car Accident Claims
A few state rules shape every Florida crash claim. Knowing them helps you ask better questions when you speak with any of the firms above.
- Two-year deadline. Under section 95.11, Florida Statutes, an action founded on negligence must be filed within two years. The change came with HB 837, signed March 24, 2023. Older crashes may follow the previous rule, so confirm your date with a lawyer.
- Fault over 50 percent. Section 768.81(6) bars recovery for a party found more than 50 percent at fault for their own harm. At 50 percent or less, damages are reduced by your share of fault.
- PIP and the 14-day rule. Florida’s no-fault coverage, under section 627.736, pays 80 percent of medical costs up to $10,000. You must get initial care within 14 days, and the limit drops to $2,500 without an emergency medical condition finding.
- Pain and suffering threshold. Section 627.737(2) allows those damages only for permanent injury, significant and permanent loss of a bodily function, significant scarring or disfigurement, or death.
